Whilst you demonstrated your knowledge of different contract types and elements of best practice contract management, your discussion was largely theoretical in nature. You adopted an academic rather than practical approach, for example, describing different approaches to the definition of quality. Your word count would have been better utilized in a more practical discussion about the effectiveness of the terms and conditions you selected for analysis. You included a number of models which were not applied to your context, for example, Kraljic and the contract lifecycle management. Although you identified a number of relevant clauses, and in places, explained their purpose, had you analyzed their effectiveness in protecting S-Chem against the risks outlined in the question, your discussion would have been significantly improved. Your discussion of the clauses that helped manage the risk of poor quality was missing, since you only included a clause related to the extension of time in this section. You also needed to focus on the contractual terms and conditions relating to the risk of price increases, rather than include a wider discussion on tender management and pricing methods. You included a number of clauses where S-Chem generally negotiates with suppliers at section 4.84. Had you related some of these key clauses to the risks outlined in the question task, your assignment would have been significantly improved. Similarly, if you had discussed some of the actual performance measures and KPI’s in the contract you were analyzing, rather than including a theoretical discussion of commonly used KPIs, your assessment might have been further improved. You also appeared to confuse the battle of the forms with the contract negotiation process.Your conclusion should draw together your key findings from your research in a summary form.
